For Realtors like me, this new era requires adaptation, innovation, and a fresh perspective on how to continue serving the best interests of our clients. These changes represent the most significant shift in America’s real estate market in a century.
What’s Changing?
If you were listing your stunning Eucalyptus Hill property pictured above, you'd want to be fully informed about the latest changes in the real estate industry. Historically, the fee structure in real estate transactions has been straightforward: a seller’s agent would charge the home seller a commission, typically around 5% or 6% of the home’s purchase price. This fee was then split between the seller’s and buyer’s agents.
All that’s changed now due to the settlement I mentioned above. Two key rule changes took effect in August of 2024 as part of the settlement.
Key Real Estate Commission Rule Changes
- Compensation Details Removed from Multiple Listing Services (MLS)
One of the most significant changes involves how Realtors advertise compensation. Previously, details about agents’ compensation were included in multiple listing services (MLS), which are centralized databases used by Realtors to share information about homes for sale. Under the new rules, MLS listings will no longer include compensation details. While this information can be communicated directly between agents, removing compensation from MLS listings is expected to disrupt the traditional flow of information between agents and their clients. - Mandatory Buyer Agreements
The second major change requires Realtors to discuss and formalize their compensation arrangements with prospective homebuyers upfront, something I’ve been doing all along. Agents must now enter a written buyer agreement before touring properties with clients to inform buyers that they may be responsible for paying their Realtors if the seller chooses not to cover the cost. This shift is designed to increase transparency, ensuring that buyers are fully aware of their financial obligations from the outset of the home-buying process.
